1.Agreement to these terms

By creating an account, buying a plan or using NovaMotions AI in any other way, you agree to these terms. If you use NovaMotions AI for a company or another organization, you confirm that you can accept these terms on its behalf, and "you" includes that organization.

If you don't agree with these terms, please don't use NovaMotions AI.

2.Eligibility and accounts

• You must be at least 18 years old, or the age of majority where you live if that is higher.
• Give accurate details when you sign up and keep your email address up to date, because we send receipts and important notices there.
• Keep your password and API keys secret. You are responsible for everything that happens under your account and your keys.
• One person per account. Creating extra accounts to get more trials, avoid a suspension or get around limits is not allowed.

3.The service

NovaMotions AI lets you generate videos, images and music from text prompts and from reference files you upload, such as images, short video clips and audio. Each model has its own workspace with its own options, such as length, resolution, aspect ratio and sound.

Models are offered under their public names. Behind each one we run your request on model infrastructure we choose, and we may route a request differently depending on your settings so that it runs efficiently. We may add, change or retire models and features at any time, and we will try to give notice of changes that matter.

Generative AI produces different results each time and can make mistakes. We don't promise that an output will match your prompt or references exactly, be free of errors or be fit for a particular purpose.

NovaMotions AI is an independent platform. We are not affiliated with, endorsed by or sponsored by the developers of the models named on our site.

4.Plans, trials and payments

We offer monthly plans, yearly plans and one-time plans, plus top-up credit packs. The current prices, credits and limits of each plan are shown on the pricing page and at checkout.

• Paid trials. Each recurring plan can start with a paid trial of 7 days. You pay the trial fee upfront and receive trial credits right away. On day 8 the trial converts to the monthly plan and you are charged the monthly price, unless you cancel before then. Each person can use one trial.
• Monthly and yearly plans renew automatically at the end of each period until you cancel.
• One-time plans are charged once, never renew and give credits that stay valid for 6 months.
• Top-up packs can be bought while you have an active plan or trial.

Payments are processed by our payment partner, which acts as the merchant of record, collects sales tax or VAT where it applies and issues your receipts. Prices may change in the future, but a change never affects a period you have already paid for.

5.Credits

Credits are how generations are priced. They are a right to use the service, not money. They have no cash value, can't be transferred or sold and are not refundable except as described in our Refund policy.

• Price before you start. Each workspace shows the credit price for your exact settings before you generate. The price depends on the model, length, resolution, number of results and whether sound is on.
• Charged once. Credits are taken when a generation starts. If the generation fails, every credit it used is returned automatically.
• Plan limit per generation. Each plan has a largest single generation, shown on the pricing page in credits. A generation above that limit is blocked before anything is charged.
• Order of use. Credits that expire soonest are used first. Top-up credits are used last.

When credits expire

If your plan ends, credits that have not expired stay usable until their own expiry date.

6.Cancellation

You can cancel a trial or a plan at any time from your account. After you cancel you won't be charged again, and your plan stays active until the end of the period you already paid for. Refunds are handled under our Refund policy.

7.Your content

"Inputs" are the prompts, lyrics and reference files you provide. "Outputs" are the videos, images and songs NovaMotions AI generates for you.

• Your references must be yours to use. Only upload images, video, audio, voices and likenesses that you own or have permission to use for this purpose. You are responsible for your inputs and for having every right and consent they require.
• You own your outputs. As between you and us, you keep the rights in your inputs and you own your outputs, to the extent the law allows. On paid plans, trials and one-time plans you may use outputs commercially, as described in our Commercial license. Outputs can be similar to what other people create, and some countries limit copyright protection for AI-made media.
• What you allow us to do. You give us the permission we need to store, process and display your inputs and outputs to run the service for you, for example to keep your history, create previews and show a share page if you publish one. We don't use your private inputs or outputs to train our own models.
• Your responsibility. Check outputs before you use them, especially where they could involve trademarks, recognizable people or other people's work.

8.Acceptable use

You must follow our Acceptable use policy. Among other things it forbids any sexual content involving minors, non-consensual intimate imagery, deceptive deepfakes of real people, content that promotes violence or hate, and attempts to get around our safety checks. Automated safety checks may block a prompt, a reference or an output. A blocked generation returns its credits.

9.Public API

With an API key you can create videos, images and songs from your own software. API usage draws from the same credit balance, at the same prices and with the same plan limits as the web studio, and these terms and our Acceptable use policy apply to every request.

• Keep your keys secret and rotate a key if you think it has leaked. Usage under your keys is charged to your account.
• Respect the rate limits shown in the developer docs. We may slow down or suspend a key that harms the service or other users.
• If you let other people send prompts through your integration, you are responsible for their content and for passing on the rules in our Acceptable use policy.
• You may not resell raw access to the API as a competing generation service without our written agreement.

10.Our intellectual property

The NovaMotions AI name, logo, website, studio and documentation belong to us or our licensors. These terms don't give you any right to use them except to use the service. Model names belong to their owners and appear on our site only to describe what each workspace offers.

11.Suspension and termination

You can close your account at any time from your account settings. We may suspend or close an account, remove content or revoke API keys if we reasonably believe these terms or our Acceptable use policy were broken, if the law requires it or to protect other users and the service. Where it's appropriate we will tell you why. Credits on an account closed for a serious breach are not refunded.

12.Disclaimers

The service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the service will be uninterrupted or error free, or that any model will stay available.

13.Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim about the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law.

14.Indemnity

You agree to defend and indemnify the operator of NovaMotions AI against claims arising from your inputs, your use of outputs or your breach of these terms, to the extent the law allows.

15.Governing law and disputes

These terms are governed by the laws of the country where the operator of NovaMotions AI is registered, without regard to conflict of law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live. Please contact us first so we can try to solve any problem informally.

16.Changes to these terms

We may update these terms as the service changes. If a change is significant, we will tell you by email or in the studio before it takes effect. If you keep using NovaMotions AI after a change takes effect, the updated terms apply.
